BACKGROUND
The Telecel TGMA products and initiatives (hereinafter referred to as the “Offer” or “TGMA Initiatives”) is a Product of Ghana Telecommunications Company Limited (trading as Telecel Ghana and hereinafter referred to as “Telecel”). A Telecel Ghana Subscriber’s continued participation constitutes the member’s acceptance of any changes to these Terms and Conditions. Participants are responsible for remaining knowledgeable as to any changes that Telecel may make to these Terms and Conditions. Telecel will endeavour to make available the Terms and Conditions and any changes thereto on the Telecel Platform which shall primarily be the Telecel Play App (https://telecel.me/TelecelPlayApp).

DURATION
The duration for the initiatives shall run from the start to end date specified below:

 GENERAL ELIGIBILITY

• The following categories of customers are qualified to participate in the promo.
  1.Consumer prepaid Customers
  2.Consumer hybrid Customers
  3.Enterprise prepaid Customers
  4.Enterprise hybrid Customers

• Telecel Staff, vendors, distributors, partners, and any person or party affiliated with Telecel or related to its Staff may participate but shall not be eligible to reap the benefit or reward of these initiatives.

 

TGMA SPECIAL SHOUTOUTS
As part of the TGMA initiative, we are giving You the chance to record and upload a 5-10 second video shoutout to your favourite artiste and potentially have it featured at the TGMA 27 event! The best part? Your video could be featured in one of the many exciting events leading up to the main TGMA’27 show or even at the event itself!

• Customers shall be required to use the Telecel Play App (https://telecel.me/TelecelPlayApp) to participate In the TGMA ’27 shoutout.
• By submitting a video, participants shall give an unconditional consent to Telecel to use their videos and other relevant personal data for publicity or marketing purposes.
• Videos uploaded for the TGMA’27 Shoutout may be selected to be featured in one of the many events leading up to the TGMA’27 main event or during the main TGMA awards night.
• Participants will be charged a fee of GHS 5.00 for each video uploaded.
• Participants will receive FREE 100 minutes to call any Telecel number (on-net) valid for 3 days each time a video is uploaded and paid for.
• Telecel reserves the right to select and broadcast or feature the submitted videos across any channel before, during and after the main TGMA awards event.
• Telecel reserves the right to edit and brand the submitted videos with Telecel and TGMA logos with the intent to share or redistribute the video across any channel.

TGMA BUNDLE TO VOTE
This is the perfect opportunity to support your favourite artiste nominated for Artiste of the Year (AOTY) at the TGMA 27^th edition with Telecel’s exciting TGMA Bundle-to-Vote promo! We have created special data bundles after each artiste in each category, namely; the TGMA AOTY, Telecel Most Popular Song of the Year, Gospel Artiste of the Year & Best Afropop Song of the Year, and for every bundle you purchase, not only will you get the allocated data to stay connected, your vote will also be automatically counted for the artiste tied to that bundle while earning points to walk away with grand rewards at the crowning event. Each nominee in each category is assigned the same six(6)  special bundles, ensuring fairness throughout the voting process.

• These bundles shall be available on Telecel Play App (https://telecel.me/TelecelPlayApp) or via USSD *1767#
• 6 data bundles will be made available under each artiste nominated under each category.
• Each bundle purchased under the a category will be associated with corresponding number of votes to be allocated to the artiste for the category which they are nominated for, while customer earns points for rewards.
• 20-vote counts will be the maximum number of votes a Participant can give an artiste per category.
• Customers shall be allowed to buy the bundles multiple times. However, in the event the 20 maximum vote count has been reached, any new vote will not be counted or assigned to the artiste and the category nominated for. However, data allocation and points earned will be given to customer.
• Telecel will reserve the right to amend or update the bundle at any time.

Limitation of liability

• Telecel accepts no responsibility whatsoever for, including without limitation, any error, omission, interruption, defect, delay in operation or transmission, communications, line failure when it is not under its direct control.
• Telecel reserves the right to suspend the Promotion temporarily for operational reasons (e.g., for repairs, planned maintenance or upgrades) whenever it is deemed necessary. Telecel promises to restore the Promotion as soon as possible after any temporary suspension period.
• If Telecel Ghana improperly denies a participant any benefits that the participant ought to have earned under the Promotion, the participant’s exclusive remedy shall be the issuance of the improperly denied benefits by Telecel, if available, or such other reasonable alternative and comparable benefits as determined by Telecel. In the event of any of the aforementioned improper denials, the liability of Telecel shall be limited to the value of the benefits concerned.

Disclaimer of Warranties

• Telecel makes no warranty, implied or express, that any part of the promotion will be uninterrupted and error-free.
• Neither Telecel nor any of its directors, employees, agents, or suppliers shall accept any responsibility for any damage, loss, injury, or disappointment suffered by any customer for participating in the Promotion.
• By entering the Promotion, customers agree that no claim relating to such losses or injuries (including special, indirect, and consequential losses) shall be asserted or made against Telecel, its parent companies, affiliates, directors, officers, employees, or agents from any and all losses, damages, rights, claims and actions of any kind resulting from acceptance or use of any prize, including without limitation, personal injuries, death and property damage.

Data Protection and Publicity

• Telecel, as a Data Controller, may disclose Participants’ data to its contractors, agents, regulators, group companies, affiliates, or other third parties (data processors) in line with the Data Protection Act, 2010 (Act 843) to assist in conducting this Promotion or any future promotions.

 

Miscellaneous

• Telecel reserves the right to terminate, suspend, cancel, and/or amend the Promotion as well as these Terms and Conditions at any time. Any changes shall be binding on the customer.
• Telecel reserves the right to reverse any cashbacks on suspicion of misuse or fraud by a customer.
• Participants are liable for any claims from third parties, including the tax authorities, arising from participation in this Promotion.
• In the event of dispute regarding the interpretation of the Terms and Conditions, conduct, results, and all other matters relating to the promotion, the decision of Telecel shall be final and without appeal.
• These Terms and Conditions shall remain in full force and effect while the Promotion lasts (not taking into account temporary suspensions of the Promotion for operational reasons, e.g., for repairs, planned maintenance or upgrades).
• These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Ghana.
