TELECEL PLAY E COMMERCE (GHANA) – TERMS & CONDITIONS

INTRODUCTION

These Terms and Conditions govern the use of the Telecel Play E?Commerce Marketplace operated by Telecel Ghana. By accessing or using the Telecel Play E-commerce Platform, users agree to be bound by all terms, policies, and operational rules, including the Telecel Cash and the Telecel Play Terms and Conditions.

 

  1. DEFINITIONS
    a.”Telecel” refers to Telecel Ghana, operator of Telecel Play E-commerce Marketplace.
    b.”User” refers to any person accessing the Platform.
    c.”Merchant” refers to sellers onboarded locally by Flood or internationally via Trade Enablers.
    d.”Delivery Service Providers” refers to partners such as GIG Logistics for international shipping.
    e.”Product” refers to any item listed for sale on the platform.

 

  1. ROLE OF TELECEL

Telecel provides a digital marketplace but is not the manufacturer, owner, or seller of any product. All product-related obligations remain with Merchants and Logistics service providers. Telecel also facilitates payments through Telecel Cash but is not responsible for product quality, delivery, or merchant obligations.

 

  1. USER OBLIGATIONS

Users agree to:

  1. Provide accurate personal information.
  2. Ensure timely collection of orders.
  3. Use the Platform in compliance with applicable laws.

 

  1. MERCHANT OBLIGATIONS

Merchants must:

  1. Provide accurate and truthful product descriptions.
  2. Fulfill orders within agreed timelines.
  3. Comply with all Ghanaian e?commerce and consumer protection laws.

 

  1. ORDER MANAGEMENT

All orders placed on the Platform constitute a customer’s offer to purchase. Acceptance of this offer occurs only when the merchant confirms product availability and dispatch. Telecel Play E-commerce Market Place reserves all the right to cancel or reject orders where necessary.

 

  1. PRICING AND PAYMENTS

Prices displayed on the platform are determined by merchants and may include applicable service charges.

 

Payments may be processed through Telecel cash, or other authorized payment methods and must comply with payment provider rules. Telecel may process payment reversals in cases of failed transactions, following investigations.

 

  1. DELIVERY TERMS

Local delivery is handled by merchants directly, upon customer request. Delivery timelines are estimates and may vary due to external factors including customs, weather, or operational delays as communicated by merchants.

 

  1. RETURNS, REFUNDS & CANCELLATIONS

Refunds, returns and reversals follow Telecel’s E-commerce Refund Policy. Returns will be handled directly between the customer and the merchant. Telecel and it’s partners may only be involved in matters o f escalation/investigation with no general acceptance of liability.

 

  1. LIMITATION OF LIABILITY

Telecel is not liable for:

  1. Product defects or inaccuracies.
  2. Loss, delays, or damage caused by Merchants or Logistics Service Providers.
  3. Customs seizures or regulatory restrictions.

 

  1. DATA PRIVACY

User data is processed under Telecel’s Data Privacy Policy and applicable data protection laws.

 

  1. PROHIBITED ACTIVITIES

Users may not:

  1. Abuse the Platform.
  2. Engage in fraudulent transactions.
  3. Interfere with operational systems.

 

Merchant may not:

  1. Misrepresent items sold on the platform
  2. Manipulate reviews or ratings.
  3. Sell illegal or restricted items.
  4. Cancel confirmed orders without valid reasons.
  5. Engage in fraud or deceptive practices

 

  1. INTELLECTUAL PROPERTY

All content on the Platform, including trademarks, UI elements, and branding, are owned by Telecel and its licensed partners.

 

  1. TERMINATION

Telecel may suspend or terminate accounts for violations of these Terms.

 

  1. DISPUTE RESOLUTION

Disputes shall be resolved through Telecel’s customer support

 

  1. AMENDMENTS

Telecel may revise these Terms at any time. Continued use after updates constitutes acceptance.
